ATSAKYMAS. Atsakant į Jūsų klausymą, prastovos laikotarpiu darbuotojas atvykti į darbą neprivalo, nebent yra darbdavio reikalavimas būti darbo vietoje. Tuo atveju, jei nėra darbdavio reikalavimo, prastovos laikotarpiu darbuotojui būti darbo vietoje, darbuotojas gali dirbti kitame darbe.

Tačiau atkreiptinas dėmesys į tai, kad darbdavys bet kada gali pareikalauti grįžti į darbą.

Prastovos laikotarpiu įsidarbinimas kitame darbe nelaikytinas antraeilėmis pareigomis, tai tiesiog nebus pagrindinis darbas. Mokėtini mokesčiai nesiskiria, kadangi, tai toks pats darbas kaip ir pagrindinis.

 Šiuo atveju Jums dar reikia žinoti, kad vadovaujantis LR Darbo kodekso 128 str.1 d darbuotojas turi teisę nutraukti neterminuotą darbo sutartį, taip pat terminuotą darbo sutartį, sudarytą ilgesniam kaip šešių mėnesių laikui, jeigu jo darbo vietoje darbo sutartyje nustatytu darbo laiku prastova ne dėl darbuotojo kaltės tęsiasi ilgiau kaip trisdešimt dienų iš eilės arba jeigu ji sudaro daugiau kaip šešiasdešimt dienų per paskutinius dvylika mėnesių, taip pat jeigu jam daugiau kaip du mėnesius iš eilės nemokamas visas jam priklausantis darbo užmokestis (mėnesinė alga).
