Kaip atleisti nuteistą darbuotoją?

„Kaip teisingai atleisti darbuotoją, kuris baudžiamojoje byloje nuteistas 9-iems metams atliekant bausmę pataisos namuose? Nuo kurios datos jį būtų galima atleisti,kaip žymėti darbo laiko apskaitos žiniaraščiuose, kaip jam pranešti?“, klausia VersloSavaite.lt skaitytojas. Atsakymas. Darbo sutartis su darbuotoju gali būti nutraukta be įspėjimo pagal LR DK 136 str., 1. d. 1. p. jeigu jau yra įsiteisėjęs teismo nuosprendis, pagal kurį darbuotojas nuteisiamas bausme, dėl kurios jis negali tęsti darbo.

Vadinasi, gavę įsiteisėjusį teismo nuosprendį tą pačią dieną galite darbuotoją ir atleisti atleidimo dokumentus (darbo sutarties nutraukimą, įsakymą dėl darbo sutarties nutraukimo ir pan.) išsiunčiant darbo sutartyje nurodytu gyvenamosios vietos adresu registruotu paštu.

 

Jeigu esate gavę iš valstybės institucijų apie darbuotojo nušalinimą nuo pareigų, tuomet turėtumėte darbo laiko apskaitos žiniaraštyje žymėti NN. Jeigu nesate gavę iš jokių valstybės institucijų jokio dokumento, tuomet turėtumėte žymėti PB.
