Klausimas. Kaip man žinoma, darbuotojas nesutikdamas su savo atleidimu iš darbo per vieną mėnesį gali apskųsti tai teisme. Situacija tokia: darbuotojui 14 d. pranešta žodžiu, kad jį atleidžia, bet jokių atleidimo lapelių, jokių dokumentų nebuvo nei gauta, nei pasirašyta.

Darbuotojas jau atleistas nuo 15 d., tačiau oficialiai gavo pranešimą, kad yra atleistas – 30 d., bei tada 30 d. pasirašė ir šalia nurodė datą. Norėčiau Jūsų paklausti, nuo kokios dienos skaitysis tas apskundimo terminas (vienas mėnuo) nuo 14 d., ar nuo 30 d.?

Atsakymas. Visų pirma reiktų pažymėti, kad Lietuvos Respublikos darbo kodekso (toliau – LR DK) 130 str. 1 dalyje nustatyta, kad darbdavys turi teisę nutraukti darbo sutartį raštu pasirašytinai įspėjęs darbuotoją prieš du mėnesius (nustačius kolektyvinėje sutartyje – ne vėliau kaip prieš vieną mėnesį).

Šie terminai yra  minimalūs ir darbdavys neturi teisės atleisti darbuotojo anksčiau.

Taip pat pažymėtina, kad įspėjimas apie darbo sutarties nuraukimą turi būti rašytinis ir jame turi būti nurodyta: (1) atleidimo iš darbo priežastis ir aplinkybės, kuriomis motyvuojamas darbo sutarties nutraukimas; (2) atleidimo iš darbo data, bei (3) atsiskaitymo su atleidžiamu darbuotoju tvarka.

Kadangi iš Jūsų užduoto klausimo galima daryti prielaidą, kad Jūs tokio įspėjimo negavote, darbdavys pažeisdamas LR DK nuostatas Jus atleido savo iniciatyva ir apie atleidimą iš darbo Jūs sužinojote 30 d., todėl LR DK 297 str. nustatytas vieno mėnesio terminas darbuotojui apskųsti jo manymu neteisėtą atleidimą iš darbo bus skaičiuojamas būtent nuo šios dienos.
