Remiantis Lietuvos Respublikos darbo kodekso (toliau – DK) 131 str. 1 d. 1 p. draudžiama įspėti apie darbo sutarties nutraukimą ir atleisti iš darbo darbuotoją laikino nedarbingumo laikotarpiu (darbo vieta ir pareigos paliekamos, jeigu darbuotojas dėl laikinojo nedarbingumo neatvyksta į darbą ne daugiau kaip 120 (šimtą dvidešimt) dienų iš eilės arba ne daugiau kaip 140 (šimtą keturiasdešimt) dienų per paskutinius 12 (dvylika) mėnesių, jei įstatymai ir kiti norminiai teisės aktai nenustato, kad tam tikros ligos atveju darbo vieta ir pareigos paliekamos ilgesnį laiką), taip pat jo atostogų metu, išskyrus DK 136 str. 1 d. nustatytus atvejus.

Taigi remiantis teisės normos analize galima konstatuoti, kad laikino nedarbingumo laikotarpiu darbuotojo iš darbo atleisti negalima. Dėl kompensacijos atleidžiant darbuotoją iš darbo reikia spręsti konkrečiu atveju, priklausomai nuo to, kokiu str. remiantis darbuotojas yra atleidžiamas iš darbo.
