ATSAKYMAS. Jeigu darbo sutartis būtų nutraukiama šalių susitarimu (Lietuvos Respublikos darbo kodekso 125 str.), tuomet Jūs turėtumėte teisę susitarti su darbdaviu dėl išeitinės išmokos dydžio. Jeigu darbo sutartis būtų nutraukiama darbuotojo pareiškimu (LR DK 127 str. 1 d.), tuomet Jūs prarastumėte teisę į išeitinę išmoką.

                      Jeigu darbo sutartis būtų nutraukiama likvidavus darbdavį, jeigu pagal įstatymus jo darbo prievoles nebuvo įpareigotas vykdyti kitas asmuo (LR DK 136 str. 1 d. 6 p.), tuomet atleistam darbuotojui išmokama jo vidutinio mėnesinio darbo užmokesčio dydžio išeitinė išmoka atsižvelgiant į to darbuotojo nepertraukiamąjį stažą toje darbovietėje:

                      1) iki dvylikos mėnesių - vieno mėnesio vidutinio darbo užmokesčio dydžio;

                      2) nuo dvylikos iki trisdešimt šešių mėnesių - dviejų mėnesių vidutinio darbo užmokesčio dydžio;

                      3) nuo trisdešimt šešių iki šešiasdešimties mėnesių - trijų mėnesių vidutinio darbo užmokesčio dydžio;

                      4) nuo šešiasdešimties iki šimto dvidešimties mėnesių - keturių mėnesių vidutinio darbo užmokesčio dydžio;

                      5) nuo šimto dvidešimties iki dviejų šimtų keturiasdešimties mėnesių – penkių mėnesių vidutinio darbo užmokesčio dydžio;

                      6) daugiau kaip dviejų šimtų keturiasdešimties mėnesių - šešių mėnesių vidutinio darbo užmokesčio dydžio.

                      Tad žiūrint grynai iš finansinės pusės Jums reikėtų įvertinti realias galimybes susitarti su darbdaviu dėl išeitinės išmokos, jeigu Jūs nutrauktumėte darbo sutartį vienu iš aukščiau įvardytų atvejų, ir tuomet spręsti, kuris variantas Jums priimtinas.
