Klausimas. Norėjau paklausti dėl turto dalybų. Esu išsiskyręs prieš metus laiko per teismą. Sutarėme, kad turtą pasidalysime draugiškai, tačiau iki šiol man nieko nedavė nors aš ir nereikalavau iš žmogiškosios puses.

Dar esu savo vardu paėmęs paskolą esant santuokoje ir ją panaudojęs smulkiems daiktams pirkti. Kadangi dar esu bedarbis ir nemokėjau alimentų, tai žmona kreipėsi į antstolius. Antstoliai užblokavo mano sąskaitas, į kurias jau kita mėn. būtų pervedama bedarbio pašalpa.

Norėjau paklausti, ar ir aš galiu kreiptis į teismą dėl turto dalybų ir kad ta skola būtų mokama iš abiejų pusės?

Kaip supratome iš pateikto klausimo, buvę sutuoktiniai nutraukė santuoką bendru tikimu.

Vadovaujantis Lietuvos Respublikos civilinio kodekso (toliau – CK) 3.51 str., sutuoktinių bendru sutikimu santuoka gali būti nutraukta, jeigu yra tenkinamos visos šios sąlygos:

- nuo santuokos sudarymo yra praėję daugiau nei vieneri metai;

- abu sutuoktiniai yra sudarę sutartį dėl santuokos nutraukimo pasekmių (turto padalijimo, vaikų išlaikymo ir pan.);

- abu sutuoktiniai yra visiškai veiksnūs.

Atsižvelgiant į tai, buvę sutuoktiniai turėjo sudaryti sutartį dėl santuokos nutraukimo pasekmių, kurią teismas savo sprendimu turėjo patvirtinti išskirdamas buvusių sutuoktinių porą.

Jeigu minėta sutartis, o tuo pačiu ir teismo sprendimas, kuriuo buvo patvirtinta sutartis, nevykdoma, galima kreiptis į teismą dėl vykdomojo rašto išdavimo. Vykdomasis raštas turi būti pateiktas antstoliui, kuris priverstine tvarka įvykdys sutarties nuostatas.

CK suteikia teisę buvusiems sutuoktiniams arba vienam iš jų kreiptis į teismą dėl santuokos nutraukimo pasekmių sutarties sąlygų pakeitimo. Teismas pakeičia sąlygas, jeigu iš esmės pasikeitė aplinkybės (vieno buvusio sutuoktinio liga, nedarbingumas ir kt.) lyginant su tomis, kurios buvo santuokos nutraukimo momentu.
