Atsakymas. Darbuotojų materialinės atsakomybės atvejai nustatyti Lietuvos Respublikos darbo kodekso (toliau – LR DK) 253 str., kur teigiama, kad darbuotojas privalo atlyginti materialinę žalą, atsiradusią dėl turto netekimo ar jo vertės sumažėjimo, sugadinimo (sužalojimo), medžiagų pereikvojimo, baudų ir kompensacinių išmokų, kurias darbdavys turėjo sumokėti dėl darbuotojo kaltės, išlaidų, susidariusių dėl sugadintų daiktų, netinkamo materialinių vertybių saugojimo, netinkamos materialinių ar piniginių vertybių apskaitos, to, kad nesiimta priemonių užkirsti kelią blogai produkcijai išleisti, materialinėms ar piniginėms vertybėms grobti, kitokių darbo tvarkos taisyklių, pareiginių ar kitų instrukcijų pažeidimo.

Tuo atveju kai su darbuotoju sudaryta visiškos materialinės atsakomybės sutartis darbuotojas privalo atlyginti visą padarytą žalą.

Išskaitų iš darbo užmokesčio pagrindai nustatyti LR DK 224 str., kurio 2 d. teigiama, kad išskaitos iš darbuotojų darbo užmokesčio padengti jų įsiskolinimą įmonei, įstaigai ar organizacijai, kurioje jie dirba, gali būti daromos administracijos nurodymu, be kita ko, siekiant atlyginti žalą, kurią darbuotojas dėl savo kaltės padarė įmonei.

Šiuo atveju administracija turi teisę duoti nurodymą padaryti išskaitą ne vėliau kaip per vieną mėnesį nuo tos dienos, kurią paaiškėjo darbuotojo padaryta žala, jei darbuotojo įsiskolinimas neviršija jo vieno mėnesio vidutinio darbo užmokesčio.

Pažymėtina, kad LR DK 226 str. nustato draudimą daryti išskaitas iš išeitinės išmokos, kompensacinių ir kitų išmokų, iš kurių pagal įstatymus neišieškoma. Jeigu darbuotojo darbdaviui padaryta žala viršija darbuotojo vieno mėnesio vidutinį darbo užmokestį, tokiu atveju žala gali būti išieškoma tik teismine tvarka.
