ATSAKYMAS. Lietuvos Respublikos Garantinio fondo įstatymo 6 str. nustato lėšų iš Garantinio fondo skyrimo tvarką.

Šio straipsnio 7 d. teigiama, kad Garantinio fondo tarybai priėmus sprendimą skirti lėšų, Garantinio fondo administratorius su bankrutuojančia ar bankrutavusia įmone arba savivaldybės tarybos įgaliota įstaiga arba jos pavedimu su juridiniu asmeniu, teikiančiu įmonių bankroto administravimo paslaugas ir parengusiu paraišką dėl lėšų skyrimo, sudaro lėšų iš Garantinio fondo perdavimo įmonei (savivaldybės įstaigai, juridiniam asmeniui, teikiančiam įmonių bankroto administravimo paslaugas) sutartį.

Lėšos pervedimos į įmonės ar savivaldybės įgalioto asmens specialiai šiam tikslui banke atidarytą sąskaitą. Iš jos per 30 d. pinigai turi būti išmokami darbuotojams.
