ATSAKYMAS. Kaip minėta ankstesnėse konsultacijose, paveldima pagal įstatymą ir pagal testamentą. Kadangi Jūsų vyras ir jo brolis savo mirusio tėvo palikimą paveldėjo skirtingomis dalimis, galima daryti prielaidą, kad Jūsų vyro tėvas buvo sudaręs testamentą ir būtent taip paskirstęs savo palikimą.

Atsakant į Jūsų klausimą dar reikėtų pažymėti, kad Lietuvos Respublikos civilinio kodekso 3.89 str. 2 dalyje, be kita ko, nustatyta, kad asmenine sutuoktinių nuosavybe pripažįstamas turtas, sutuoktinio paveldėtas po santuokos sudarymo, jeigu testamente nėra nurodyta, kad turtas perduodamas bendrojon jungtinėn sutuoktinių nuosavybėn.

Esant paminėtoms sąlygoms, jeigu testamente nebuvo nurodyta kitaip, tiek Jūsų vyrui, tiek jo broliui, paveldėtas turtas turėtų priklausyti asmeninės nuosavybės teise ir kiti asmenys teisių į tą turtą neturi.

Vadovaujantis Lietuvos Respublikos Konstitucijos 23 str. nuosavybė yra neliečiama ir paveldėtojai savo dalių niekam perduoti ar kitaip perleisti neprivalo.
