Greičiausias būdas išsiskirti yra bendru sutarimu, taikiai pasidalijant bendrą turtą. Nesant sutarimo bendrą turtą padalins teismas, atsižvelgdamas į visumą aplinkybių bei įvertinęs visus teismui šalių pateiktus įrodymus.
