Šiuo metu įmonė bankrutuoja. Ar įmanoma jį susigrąžinti? Greitai įvyks varžytinės ir jei jose jis nebus parduotas, ar galima bus ji susigrąžinti po to ar reikia iki joms įvykstant imtis kažkokių veiksmų.

ATSAKYMAS. Atsižvelgiant į įvardytos pirkimo-pardavimo sutarties ypatumus reikia paminėti, jog šiuo atveju svarbus aspektas yra nuosavybės teisės perėjimo momentas.

Atsižvelgiant į turimą informaciją teigtina, kad nuosavybės teisė pereina tik po galutinio pirkėjo atsiskaitymo. Kol atsiskaitymas nėra įvykęs, daiktas priklauso pardavėjui. Taigi ir varžytinėse toks daiktas įmonės bankroto atveju negali būti parduotas, nes šis turtas (įrengimas) nepriklauso bankrutuojančiai įmonei nuosavybės teise.

Reikia raštu kreiptis į bankrutuojančios įmonės bankroto administratorių ir jį apie tai informuoti, kartu pateikiant reikalavimą atsiimti Jums priklausantį turtą (įrengimą).
