KLAUSIMAS. Darbovietė 2009 m. rugsėjį įteikė pranešimą, kad įmonė yra bankrutuojanti ir būsiu atleistas iš darbo. (Bankroto byla jau pateikta teismui). Taip ir buvo. (Prieš atleidžiant alga jau seniai nebuvo mokama). Įvykus susirinkimui administratorius pranešė, kad bus išmokamos išeitinės bei kitos išmokos (nesumokėta alga).

Įstojus į darbo birža pirmus du mėnesius negavau pašalpos, nes darbovietė užpildė, kad man yra paskaičiuota (bet neišmokėta) išeitinė išmoka. Praėjus tiek laiko, man dar nėra grąžinta nė cento.

Kiek paskambinu administratoriui, jis vis teigia, kad procesas vykdomas, bet jokių terminų ar kitos tikslios informacijos neteikia. Kur galėčiau kreiptis? Kiek žinau, garantinis fondas per tokį laikotarpį jau turėjo pervesti pinigus? Ar negali būti, kad įmonė pasisavino darbuotojų pinigus?

ATSAKYMAS. Lėšos iš Garantinio fondo skiriamos bankrutuojančių ir bankrutavusių įmonių darbuotojams, dirbusiems įmonėje iki teismo nutarties iškelti įmonei bankroto bylą priėmimo dienos arba iki kreditorių susirinkimo nutarimo bankroto procedūras vykdyti ne teismo tvarka priėmimo dienos, neatsižvelgiant į tai, ar darbo santykiai tęsiasi, ar yra nutrūkę, taip pat buvusiems įmonių, likviduotų dėl bankroto įsigaliojus šiam įstatymui, darbuotojams, kai įmonės jiems yra įsiskolinusios, taip pat Garantinio fondo administravimo išlaidoms Garantinio fondo nuostatų nustatyta tvarka.

Sprendimą dėl Garantinio fondo lėšų skyrimo Garantinio fondo administratoriaus teikimu ne vėliau kaip per mėnesį nuo dokumentų iš Garantinio fondo administratoriaus gavimo dienos priima Garantinio fondo taryba.

Garantinio fondo tarybai priėmus sprendimą skirti lėšų, Garantinio fondo administratorius su bankrutuojančia ar bankrutavusia įmone arba savivaldybės tarybos įgaliota įstaiga arba jos pavedimu su juridiniu asmeniu, teikiančiu įmonių bankroto administravimo paslaugas ir parengusiu paraišką dėl lėšų skyrimo, sudaro lėšų iš Garantinio fondo perdavimo įmonei (savivaldybės įstaigai, juridiniam asmeniui, teikiančiam įmonių bankroto administravimo paslaugas) sutartį.

Paprastai tokie procesai užtrunka apie keletą mėnesių, priklausomai nuo bankroto administratoriaus iniciatyvumo ir noro greičiau sutvarkyti bei išspręsti klausimus, susijusius su atsiskaitymu su darbuotojais.

Galima oficialiai kreiptis į bankroto administratorių su paklausimu dėl algos ir kitų priklausančių išmokų išmokėjimo.
