Klausimas. Sveiki. Turiu bėdą. Įsidarbinant įmonėje kartu su prašymu priimt į darbą liepė parašyt prašymą atleist iš darbo. Dirbu nuo 2009 11 03.  Neseniai sužinojau, kad laukiuosi, na tarkim, kovo 15 d. (nėštumas 5 savaitės, taigi pradėjau dirbti nebūdama nėščia). Vakar (2010 04 02) darbdavys pasišaukė į kabinetą, parodė prašymą atleist iš darbo, įrašė į jį datą ir pasakė, kad nuo Velykų nebedirbu. Motyvavo, kad blogai dirbu ir tapau nėščia. Na, kol nežinojau aš ir jis, kad laukiuosi, dirbau gerai. Taigi klausimas, ar galiu kur kreiptis dėl tokio atleidimo? Ar turiu šansų ką nors pasiekt? Ar gali kas padėti? Ačiū už atsakymą. Atsakymas. Gerbiama Jurgita, atsakant į Jūsų klausimą reikia pažymėti, kad aplinkybė kada Jūs tapote nėščia šiuo atveju neturi visiškai jokios reikšmės, nes Lietuvos Respublikos darbo kodekso (toliau – LR DK) 132 str. nustato garantijas nėščioms moterims ir darbuotojams, auginantiems vaikus.

Šio straipsnio 1 dalyje nurodoma, kad darbo sutartis negali būti nutraukta su nėščia moterimi nuo tos dienos, kai darbdaviui buvo pateikta medicinos pažyma apie nėštumą, ir dar vieną mėnesį pasibaigus nėštumo ir gimdymo atostogoms, išskyrus atvejus nustatytas LR DK 136 straipsnio 1 ir 2 dalyse, taip pat laikinąją darbo sutartį pasibaigus jos terminui.

Iš Jūsų nusakomo atvejo galima daryti išvadą, kad darbdavys Jus atleido pagal LR DK 127 str. t.y. darbo sutarties nutraukimas darbuotojo pareiškimu, suklastodamas Jūsų prašymą atleisti iš darbo. 

Šiais savo veiksmais darbdavys šiurkščiai pažeidė ne tik LR DK, tačiau padarė ir nusikaltimą, numatytą Lietuvos Respublikos baudžiamojo kodekso 300 str. - dokumento suklastojimas ar disponavimas suklastotu dokumentu už ką jam gresia baudžiamoji atsakomybė.

Manome, kad Jūs turėtumėte ginti savo pažeistas teises, kreipiantis į teismą dėl neteisėto atleidimo iš darbo, nepraleidžiant LR DK 297 str. nustatyto vieno mėnesio termino nuo Jūsų atleidimo dienos.
