Klausimas. Mano pažįstamas užėjo į degalinę ir atsiskaitė netikrais pinigais pats to nežinodamas. Policijai jis pasakė, kad tokius pinigus gavo parduotuvėje. Bet jo kompiuteryje kriminalistai rado pinigo atvaizdą, o jį buvo gavęs iš manęs, kadangi aš juos kolekcionuoju.

Pas mane atvažiavę kriminalistai pradėjo iškart tardyti, ižeidinėti. Parodžiau jiems savo kolekciją, tada jie paėmė kompiuterį su spausdintuvu. Buvo pasakyta, kad atiduos po 3 dienų, tačiau aš jų netagaunu jau daugiau kaip metus.

Tas kompiuteris nėra naujas, bet svarbiausias dalykas, kad ten liko mano visi 4 metų studijų darbai, kurie man tolesnėse studijose labai reikalingi, taipogi asmeninių nuotraukų. Kaip man susigrąžinti savo daiktus?

Atsakymas. Lietuvos Respublikos baudžiamojo proceso kodekse (toliau – BPK) yra numatyta galimybė kratos arba poėmio metu paimti daiktus, kurie gali būti susiję su nusikaltimo tyrimu. BPK 149 str. 6 d. numatyta, kad darantis kratą ar poėmį pareigūnas turi teisę paimti tik tuos daiktus ir dokumentus, kurie gali turėti reikšmės tyrimui.

Daiktai ir dokumentai, kurių apyvarta įstatymų uždrausta, turi būti paimami neatsižvelgiant į jų ryšį su tyrimu. Paimti daiktai gražinami (jeigu nėra konfiskuojami) arba nustačius, kad jie nėra susiję su tiriamu nusikaltimu arba baigus tirti bylą (ją nutraukus).

BPK 62 str. 1 d. įtvirtinta, kad ikiteisminio tyrimo pareigūno proceso veiksmus ir nutarimus proceso dalyviai arba asmenys, kuriems taikytos procesinės prievartos priemonės, gali apskųsti ikiteisminį tyrimą organizuojančiam ir jam vadovaujančiam prokurorui.

Jei prokuroras atsisako patenkinti skundą, šis jo nutarimas gali būti skundžiamas aukštesniajam prokurorui BPK 63 straipsnyje nustatyta tvarka. Jeigu ir aukštesnysis prokuroras skundo nepatenkina, galima kreiptis į teismą.
