Paprastai rašytinėje nuomos ar kitoje sutartyje būna nurodoma kaip įforminamas priėmimo-perdavimo procesas (t.y. koks dokumentas turi būti sudaromas, kas jame turi būti nurodoma, per kiek laiko gali būti pareiškiamos pretenzijos ir pan.).

Todėl atsakyti ar minėtos nuomos sutarties prasme galima laikyti, kad nuomojamos patalpos buvo tinkamai perduotos nuomotojui - įmanoma tik pamačius pačią nuomos sutartį.

Nagrinėjant tik pačią faktinę situaciją, teigtina, kad šioje situacijoje teisiu gali būti ir nuomininkas, ir nuomotojas. Daug kas priklauso nuo to kokia žala buvo padaryta (jeigu buvo padaryta), ar nuomotojas perduodamas butą nuomininkui užfiksavo (aprašė) buto būklę ar to nepadarė.

Jeigu padaryti defektai yra lengvai pastebimi ir nuomotojas pareiškė pretenzijas tik po savaitės, nors visą tą laiką pats bute gyveno, galima daryti prielaidą, kad žalą padarė pats nuomotojas.
