Klausimas. Į darbą buvo priimtas neįgalumą turintis darbuotojas, šiuo metu jis taip pat turi neįgalumą. Ar priklauso šiam darbuotojui išeinant iš darbo išeitinė kompensacija už du mėnesius pagal LR DK 127 straipsnio 2 dalį (darbuotojo prašymu dėl darbuotojo ligos ar neįgalumo)?

Atsakymas. Lietuvos Respublikos darbo kodekso (toliau – DK) 140 straipsnio 2 dalyje įtvirtinta, kad nutraukus darbo sutartį DK numatytais pagrindais, išskyrus DK 125 (Darbo sutarties nutraukimas šalių susitarimu) ir 126 (Darbo sutarties nutraukimas suėjus terminui) straipsniuose bei 127 straipsnio 1 dalyje (Darbo sutarties nutraukimas darbuotojo pareiškimu) nustatytus atvejus, ir kituose įstatymuose nustatytais atvejais, kai nėra darbuotojo kaltės, jam išmokama jo dviejų mėnesių vidutinio darbo užmokesčio dydžio išeitinė išmoka, jeigu įstatymai ar kolektyvinės sutartys nenustato kitaip.

Atsižvelgiant į tai, teigtina, kad darbuotojui priklauso išeitinė kompensacija.
