Klausimas. Prašau pakomentuoti tokią situaciją: gavau pranešimą apie tai, kad po mėnesio bus mažinama alga ir paliekama 0,5 etato. Sprendimą, ar sutinku, turiu pareikšti per savaitę. Klausimas: ar šis apsisprendimo terminas teisingas?

Nežiūrint, kad apsispręsiu per savaitę, atlyginimas vis tiek bus mažinamas po mėnesio nuo pranešimo įteikimo. Jei nesutinku, būsiu atleidžiama vėlgi po 4 mėn. nuo pranešimo įteikimo, nors kitoje įmonėje mums aiškino, kad pirma darbuotojas turi būt įspėtas apie darbo sąlygų pakeitimą, po to per mėnesį apsispręsti ir jei nesutinka tik tada gauti pranešimą, kad bus atleidžiamas po 4 mėn.

Atsakymas. Atlikus išsamią Lietuvos Respublikos darbo kodekso (toliau – DK) atitinkamų straipsnių, reglamentuojančių Jūsų užduotą klausimą, analizę, darytina išvada, jog DK nenustato konkrečių terminų darbdaviui, kurių laikydamasis darbdavys turėtų informuoti darbuotoją apie darbo sąlygų pakeitimą. Terminas turi būti vertinamas atsižvelgiant į protingumo kriterijus kiekvienu konkrečiu atveju.

Darbdavys turi teisę nutraukti darbo sutartį raštu pasirašytinai įspėjęs darbuotoją prieš du mėnesius (nustačius kolektyvinėje sutartyje – ne vėliau kaip prieš vieną mėnesį).

Darbuotojai, kuriems iki teisės gauti visą senatvės pensiją liko ne daugiau kaip penkeri metai, asmenys iki aštuoniolikos metų, neįgalieji, darbuotojai, auginantys vaikus iki keturiolikos metų, apie atleidimą iš darbo turi būti įspėti ne vėliau kaip prieš keturis mėnesius (nustačius kolektyvinėje sutartyje – ne vėliau kaip prieš du mėnesius).

Taigi dėl termino prieš kurį darbuotojas turi būti įspėtas apie darbo sutarties nutraukimą reikia spręsti atsižvelgiant į tai, kokiai kategorijai darbuotojų konkretus darbuotojas yra priskiriamas.
