ATSAKYMAS. Kai keičiama gamyba, jos mastas, technologija arba darbo organizavimas, taip pat kitais gamybinio būtinumo atvejais darbdavys turi teisę pakeisti darbo sutarties sąlygas. Jei darbuotojas nesutinka dirbti pakeistomis darbo sąlygomis, jis gali būti atleistas iš darbo darbdavio iniciatyva, kai nėra darbuotojo kaltės, laikantis nustatytos darbo sutarties nutraukimo tvarkos.

Darbo sutarties sąlygos (t. y. darbuotojo darbovietė (įmonė, įstaiga, organizacija, struktūrinis padalinys ir kt.) ir darbo funkcija, t. y. tam tikra profesija, specialybė, kvalifikacija arba tam tikros pareigos, o atskiroms darbo sutarčių rūšims darbo įstatymuose ir kolektyvinėse sutartyse gali būti nustatomos ir kitos būtinosios sąlygos, kurias šalys sulygsta sudarydamos tokią darbo sutartį (susitarimas dėl sutarties termino, sezoninio darbo pobūdžio ir kt.)), gali būti keičiamos esant išankstiniam raštiškam darbuotojo sutikimui, išskyrus, kai yra laikinas darbo sąlygų pakeitimas ypatingais atvejais.

Darbo apmokėjimo sąlygas be darbuotojo raštiško sutikimo darbdavys gali keisti tik tuo atveju, kai įstatymais, Vyriausybės nutarimais ar pagal kolektyvinę sutartį yra keičiamas tam tikros ūkio šakos, įmonės ar darbuotojų kategorijos darbo apmokėjimas. Keičiant darbo apmokėjimo sąlygas, sumažinti darbo užmokestį be darbuotojo raštiško sutikimo negalima.

Keičiant darbo sutarties sąlygas, pakeitimai įforminami abiejuose darbo sutarties egzemplioriuose.

Iškilus ginčui darbo ginčai nagrinėjami darbo ginčų nagrinėjimo tvarka, t. y. reikia kreiptis į darbo ginčų nagrinėjimo organą arba į Lietuvos Respublikos Valstybinę darbo inspekciją.
