Atsakymas. Pradžioje pažymėsime, vadovaujantis Lietuvos Respublikos darbo kodekso (toliau – DK) 166 str. 1 d., kasmetinių minimalių atostogų trukmė yra dvidešimt aštuonios kalendorinės dienos. Tiek dienų per metus turi teisę atostogauti didesnė dalis Lietuvoje dirbančių asmenų.

Tačiau, esant tam tikroms aplinkybėms, darbuotojas įgyja teisę ir į ilgesnės trukmės atostogas. DK 166 str. 2 d. įtvirtinta, kad kasmetinės minimaliosios trisdešimt penkių kalendorinių dienų atostogos suteikiamos darbuotojams iki aštuoniolikos metų, darbuotojams, vieniems auginantiems vaiką iki keturiolikos metų arba neįgalų vaiką iki aštuoniolikos metų, taip pat neįgaliesiems.

Atsižvelgiant į tai, teigtina, kad, jeigu Jūs viena auginate vaikus, vienam iš kurių yra aštuoneri metai, darbdavys Jums turi suteikti ne dvidešimt aštuonių dienų trukmės kasmetines atostogas, o trisdešimt penkių dienų.
