KLAUSIMAS. Gavau įspėjimą apie atleidimą iš darbo darbdavio iniciatyva. Dar dirbsiu du mėnesius. Man sumokės 2 mėnesių darbo užmokesčio dydžio išeitinę išmoką, kai turėtų būti vidutinio darbo užmokesčio, juolab, kad pas mane vidutinis didesnis, nei darbo užmokestis, nes priedai priklausomi nuo apyvartų. Pasirašiau aš tą įspėjimą ir tik vėliau pastebėjau šitą netikslumą.

Jei darbdavys nesutiks perrašyti, ką daryti tokiu atveju? O gal tai teisiškai traktuojama kaip tas pats, nes numatyta įstatyme? Ir dar, ar darbdavys gali atleisti už tariamus drausmės pažeidimus be įspėjimo ir nubraukiant visas išeitines per įspėjimo laikotarpį? Labai ačiū už atsakymus.

ATSAKYMAS. Remiantis Lietuvos Respublikos darbo kodekso (toliau – DK) 140 str. nutraukus darbo sutartį darbdavio iniciatyva, kai nėra darbuotojo kaltės, atleistam darbuotojui išmokama jo vidutinio mėnesinio darbo užmokesčio dydžio išeitinė išmoka atsižvelgiant į to darbuotojo nepertraukiamąjį stažą toje darbovietėje.

Tai yra imperatyva įstatymo norma, vadinasi, darbdavys, atleisdamas darbuotoją savo iniciatyva kai nėra darbuotojo kaltės privalo remtis minėta DK nuostata bei neturi teisės jos pakeisti taip pablogindamas darbuotojo padėtį.

Atleidžiant darbuotoją iš darbo dėl darbo pareigų pažeidimo nėra numatyta jokių išmokų, kai darbuotojas atleidžiamas dėl jo paties kaltės. Jei darbuotojas mano, kad jo kaltės nėra ir jis atleistas neteisėtai, tuomet vėlgi jis turi teisę kreiptis į teismą ir visa tai įrodinėti.
