KLAUSIMAS. Gavau įspėjimą apie darbo sutarties nutraukimą, kad darbovietėje šiuo metu nėra laisvos vietos ir kad atleidžiama vadovaujantis LR Darbo kodekso 129 straipsnio 2 dalies bei 130 straipsnio nuostatomis. Įmonėje esu išdirbusi 8 metus, turiu neįgalumo grupę, esu 35 proc. darbingumo.

Įmonėje iš visų dirbančiųjų esu išdirbusi ilgiausiai. Noriu sužinoti kokio dydžio išeitinė kompensacija man priklauso ir ką patartumėte daryti dėl darbo. Gal teisiniu požiūriu galiu kreiptis į teismą, dėl sugrįžimo į darbą? Ačiū.

ATSAKYMAS. Remiantis Lietuvos Respublikos darbo kodekso (toliau – DK) 140 str. nutraukus darbo sutartį pagal DK 129 straipsnį, atleistam darbuotojui išmokama jo vidutinio mėnesinio darbo užmokesčio dydžio išeitinė išmoka atsižvelgiant į to darbuotojo nepertraukiamąjį stažą toje darbovietėje:

                      1) iki dvylikos mėnesių - vieno mėnesio vidutinio darbo užmokesčio dydžio;

                      2) nuo dvylikos iki trisdešimt šešių mėnesių - dviejų mėnesių vidutinio darbo užmokesčio dydžio;

                      3) nuo trisdešimt šešių iki šešiasdešimties mėnesių - trijų mėnesių vidutinio darbo užmokesčio dydžio;

                      4) nuo šešiasdešimties iki šimto dvidešimties mėnesių - keturių mėnesių vidutinio darbo užmokesčio dydžio;

                      5) nuo šimto dvidešimties iki dviejų šimtų keturiasdešimties mėnesių – penkių mėnesių vidutinio darbo užmokesčio dydžio;

                      6) daugiau kaip dviejų šimtų keturiasdešimties mėnesių - šešių mėnesių vidutinio darbo užmokesčio dydžio.

                      Dėl galimybės kreiptis į teismą – tokią teisę Jūs visada turite, tačiau reikia įvertinti tai, ar turėsite svarių argumentų apginti bei įrodyti savo poziciją.
