ATSAKYMAS. Remdamasis Lietuvos Respublikos darbo kodekso (toliau – DK) 136 str. 3 d. 2 p. darbdavys turi teisę nutraukti darbo sutartį apie tai iš anksto neįspėjęs darbuotojo kai darbuotojas vieną kartą šiurkščiai pažeidžia darbo pareigas.

Vienu iš šiurkščių darbo pareigų pažeidimų yra laikoma veika, turinti vagystės, sukčiavimo, turto pasisavinimo arba iššvaistymo, neteisėto atlyginimo paėmimo požymių, nors už šią veiką darbuotojas ir nebuvo traukiamas baudžiamojon ar administracinėn atsakomybėn.

Skiriant griežčiausią drausminę (kaip ir bet kokią kitą) nuobaudą reikia laikytis drausminės nuobaudos skyrimo tvarkos, t. y. skiriant drausminę nuobaudą turi būti atsižvelgiama į darbo drausmės pažeidimo sunkumą ir sukeltas pasekmes, darbuotojo kaltę, į aplinkybes, kuriomis šis pažeidimas buvo padarytas, į tai, kaip darbuotojas dirbo anksčiau.
