Atsakymas. Esamo ar būsimo skolinio įsipareigojimo įvykdymą užtikrinantis nekilnojamojo daikto įkeitimas, kai įkeistas daiktas neperduodamas kreditoriui yra vadinamas hipoteka.

Jeigu klausime minimi nekilnojami objektai yra įkeisti banko naudai, t.y. siekiant prievolių bankui įvykdymą, įkeisto daikto savininkas neturi teisės sunaikinti, sužaloti daiktą ar kitaip sumažinti jo vertę, išskyrus daikto normalų nusidėvėjimą ar vertės sumažėjimą naudojant jį būtinojo reikalingumo atveju.

Pažeidus šiuos reikalavimus, hipotekos kreditorius (šiuo atveju - bankas) gali reikalauti, kad būtų pradėtas išieškojimas iš įkeisto daikto prieš terminą. 

Atsižvelgiant į tai, teigtina, kad nugriauti namų be banko sutikimo – negalima.
