Lietuvos Respublikos Darbo kodekso (toliau – LR DK) 184 str. 1 dalyje nustatytas baigtinis sąrašas kada ir kokios trukmės nemokamos atostogos darbuotojo reikalavimu yra suteikiamos:

1)                  darbuotojams, auginantiems vaiką iki keturiolikos metų - iki keturiolikos kalendorinių dienų;

2)                  darbuotojams, auginantiems vaiką invalidą iki šešiolikos metų - iki trisdešimties kalendorinių dienų;

3)                  moters nėštumo ir gimdymo atostogų metu bei vaiko priežiūros, kol jam sueis treji metai, atostogų metu tėvui jo pageidavimu (motinai - tėvo atostogų vaikui prižiūrėti, kol jam sueis treji metai, metu); šių atostogų bendra trukmė negali viršyti trijų mėnesių;

4)                  invalidui - iki trisdešimties kalendorinių dienų per metus; darbuotojui, vienam slaugančiam invalidą, kuriam invalidumą nustatančios komisijos sprendimu nustatytas nuolatinės slaugos būtinumas, - iki 30 kalendorinių dienų per metus šalių suderintu laiku;

5)                  darbuotojui, slaugančiam sergantį šeimos narį – tokiam laikui, kurį rekomenduoja gydymo įstaiga; santuokai sudaryti - ne mažiau kaip trys kalendorinės dienos; mirusio šeimos nario laidotuvėms - ne mažiau kaip trys kalendorinės dienos.

Šis sąrašas yra baigtinis, todėl galimybės suteikti nemokamas atostogas daugiau nei 3 mėnesiams išvažiuoti į užsienį nėra.
