KLAUSIMAS. Norėčiau paklausti, kokie galimi teismo sprendimai skyrybų metu dalijant 2 kambarių bendros nuosavybės turtą. Bute gyvename su nepilnamete dukra. Žmona pareiškė, kad nori vykti dirbti ir gyventi i užsienį bei pateiks teismui ieškinį dėl santuokos nutraukimo dėl kito sutuoktinio kaltės.

Klausimas būtų toks: ar teismas gali įpareigoti parduoti butą tam, kad dalį pinigų sumokėti sutuoktinei, vykstančiai i užsienį? Vyras lieka su nepilnamete dukra gyventi Lietuvoje, o kito turto ar pinigų įsigyti naujam butui neturi.

ATSAKYMAS. Esant tam tikroms sąlygoms teismas galėtų duoti tokį įpareigojimą. Tačiau teismai, tokio pobūdžio bylose, priimdami sprendimus, visų pirma, atsižvelgia į vaiko interesus.

Ir jeigu vienintelis šeimos turtas yra butas, kuriame gyvena pilnametystės nesulaukęs vaikas, tuomet nelabai tikėtina, kad teismas priimtų sprendimą, kuriuo būtų duotas įpareigojimas parduoti vienintelį šeimos turtą ir pasidalyti lėšas.

Tačiau vertinant situaciją taip pat reikia atsižvelgti ir į skyrybų priežastį (kiltų daug abejonių, jeigu skyrybos būtų dėl vieno sutuoktinio kaltės, pvz., dėl neištikimybės).
